The E-2 Treaty Investor Visa is a nonimmigrant (temporary), treaty-based visa that enables nationals of treaty countries to live and work in the United States through a qualifying investment in a U.S. enterprise. It is available to both individual investors and essential employees of companies owned by nationals of treaty countries. Upon approval, the visa allows an initial stay of up to two years, which may be renewed indefinitely in two-year increments, provided the qualifying investment and business activities continue. The visa holder may be accompanied by their spouse and unmarried children under the age of 21, with the spouse eligible to apply for work authorization. However, work authorization is limited to the specific E-2 enterprise or under qualifying terms as determined by U.S. immigration authorities.
